¿Plagio o mucha (muchísima) casualidad?

En estos meses la palabra “plagio” ha resonado en la cabeza de todos los peruanos gracias a uno de nuestros “pintorescos” candidatos presidenciales, el cual ha sido acusado de plagiar no solo su tesis doctoral sino hasta un libro completo.

Según la RAE, plagiar es “copiar en lo sustancial obras ajenas, dándolas como propias”. El plagio atenta contra los derechos de autor y por ello hay una repercusión no solo moral y ética sino también legal.

A pesar de esto, desde tiempos inmemorables, el plagio ha sido parte de nuestra sociedad en todos los sectores: la política, los negocios, el área académica, y claro, también la publicidad. En este último caso, gracias a páginas como Behance o Tumblr, donde los creativos “junior” plasman su arte, es muy fácil buscar referencias, pero algunos dejan de lado la creatividad y le dan mano a la “criollada” (viveza, astucia) para robar de manera descarada material intelectual que no les pertenece.

Veamos 4 casos de plagio (o muchísima coincidencia) en la industria publicitaria, y saquen ustedes sus propias conclusiones.

  • Ford (2008) vs. Volkswagen (2013)

Ford lanzó esta publicidad para dar a conocer que su modelo era el ideal para la ciudad. Volkswagen lanzó una gráfica muy parecida 5 años después, para comunicar que la Amarok era muy rendidora y podía recorrer muchas millas con poco combustible. ¿Ustedes qué dicen? En mi opinión, Ford lo trabajó mucho mejor tanto a nivel conceptual como gráfico.

En este caso se me viene a la cabeza una frase popular que se le podría decir a Volkswagen: “si vas a copiar, hazlo bien” (aunque en principio, no debió siquiera copiar).

  • Audi Switzerland (2015) vs. BMW France (2015)

Con motivo del estreno de la última película de Star Wars muchas marcas utilizaron sus medios sociales para realizar publicaciones relacionadas. Ese fue el caso de BMW France y Audi Switzerland; aunque los suizos no solo se tardaron un día más en publicar sino que en la imagen no se aprecia tan bien el auto, pero si miramos a profundidad podremos notar el mismo concepto: el auto y la luz del láser.

  • Adidas (2011) vs. Nike (2015)

En ambos casos se tratan de tiendas pop-up. La primera, de Adidas, se desarrolló en España y la segunda, 4 años después, fue la de Nike USA. Si bien es cierto la segunda es más llamativa por los colores y luces, me quedo con la primera: el detalle de los cordones y el sticker lateral clásico en toda caja de zapatillas seducen más. ¿Ustedes qué dicen?

Sharpie USA creó esta divertida publicidad en el 2014, y al año siguiente Bic Brasil lanzó algo muy parecido. En lo personal, prefiero la idea de Bic pues se ve más “real” pero hay que reconocer que la idea original es de Sharpie.
 
Estos son algunos de los casos más conocidos, pero aún hay muchísimos más que no salen a la luz por tratarse de empresas pequeñas y no de grandes corporaciones como las que mostré en estos ejemplos.
Lo más triste es que son al final los jóvenes creativos desconocidos los verdaderos perjudicados, pues no son reconocidos por su trabajo, son víctimas de un robo artístico (a veces sin saberlo) y no son retribuidos en lo más mínimo por sus ideas originales.  Triste, pero sucede. [:en]
